I'm not suggesting that we descend into anarchy, but that Shetland could choose how it wishes to be governed and could have control over its own affairs - just by asserting rights that already exist. My belief is that the UK government does not want to get into a legal confrontation because they know they cannot justify their position. The official line is only upheld because it is not questioned. The more Shetland property owners question it, the easier it becomes for Shetland to determine its own future. Since June 2008 the authorities have made no challenge to what I’m doing on Forvik. These activities include: - Building a house without seeking permission from the Shetland authorities.
- Disturbing the ground without seeking permission from Scottish Natural Heritage.
- Works on the seabed without seeking permission from the Crown Estates.
- Offering the surrounding seabed for oil exploration.
- Withholding VAT and income tax from HM Revenue and Customs.
- Not paying Council Tax on the house.
Forvik is intending to issue its own currency, stamps, passports and driving licenses, and to register companies, vehicles and ships. By ignoring this activity the authorities give their tacit approval. The truth is the UK government does not want to get into a position where they have to explain how they derive their authority in Shetland – which depends upon the notion that Shetland is part of Scotland. Careful study of the historical, legal and constitutional position reveals that Shetland never became part of Scotland and that its true position is that of a Crown Dependency (like the Isle of Man). This means that Shetland should have its own parliament, decide its own taxes and have control of its own affairs. This status already exists, but is not recognised by the UK government. Until documentary proof is provided showing the date on which Shetland became part of Scotland, it has to be assumed that the UK government’s authority here is non-existent and that all taxes demanded are fraudulent. Declaration of Crown Dependency status is open to any person or business that owns property in Shetland. I invite Shetland property owners to join with me to expose the deceit of the UK government and help Shetland achieve its true status. Please understand that I am not suggesting that anyone does anything illegal. I am saying that UK government taxes may well be illegal in Shetland. I am suggesting that any taxes due to local and national government should be withheld and deposited in a central holding account. The relevant authority will be advised that the money has been paid into that account and will not be released to it until the government can come up with proper evidence of its authority. When enough people take this action it will be impossible to ignore.
